The Committee on the Rights of Persons with Disabilities has published a General Comment on the "right to live independently and being included in the community" which is enshrined in art. 19 of the CRPD! (September, 2017)
The Committee has highlighted that the barriers before independent living and being included in the community are not limited to legal barriers (such as limitation of legal capacity), but also include strict control exercised by family members, care givers and others in daily contact withe the persons with disabilities over the choices made by him/her. The General Comment indicated that art. 19 requires individualized solutions and also elaborated the principles of solutions respectful of the right enshrined therein.
